ما بعد حالة الطوارئ المعلنة في فلسطين لمواجهة فايروس الكورونا: السيناريوهات ومحاذيرها (2020)

إن حالة الطوارئ ليست سوى تنظيما دستوريا لحالة استثنائية طارئة. وكونها طارئة، فلا يمكن التنبؤ مسبقاً بالوقت الكافي للتعامل مع ظرفها. وفي الحالة الفلسطينية، وعلى ضوء خبرات مختلفة في العالم، لا شك أن الظرف الطارئ القائم (تفشي الوباء) يتجاوز بالضرورة حد الثلاثين يوم الواردة في القانون الأساسي أو حتى الستين يوم (في حال تم التمديد. وهو الحد الأقصى الممكن للطوارئ بموجب نصوص القانون الأساسي). فبالإضافة إلى غياب المجلس التشريعي بالأساس، وعدم إمكانية تطبيق نصوص القانون الأساسي لغايات تمديد حالة الطوارئ ومراجعة الإجراءات المتخذة أثناءها، فقد يمتد الظرف الطارئ المرتبط بالوباء إلى عدة شهور؛ فما العمل في هذه الحالة؟ هذا ما عنيت به هذه الورقة بنقاشه، طارحة عدة سيناريوهات متوقعة ومحذرة من مخاطرها.

 The state of emergency is only a constitutional regulation of an exceptional emergency. Given that it is an emergency would mean that it is not possible to predict in advance the sufficient time needed to deal with its circumstances. In the Palestinian case, and in light of various experiences around the world, there is no doubt that the current emergency (the outbreak of a pandemic) would necessarily exceed the 30 days period stipulated in the Basic Law, perhaps even the 60 days (in case of extension, which is the maximum period for a state of emergency in accordance to the Palestinian Basic Law). Given the absence of the Legislative Council in the first place, and hence the inability to apply the provisions of the Basic Law pertaining to the extension of the state of emergency and review of measures taken during it, the emergency associated with the pandemic might extend for several months; What could be done in this case? This is what this paper argues, presenting different expected scenarios and warning against their risks.
