إسرائيل إلى المحكمة: العقبات والتحديات (2019)

بذل المجتمع الدولي جهوداً جبّارة لإقامة نظام جنائي فعال يطبق على مستوى دولي، لملاحقة مرتكبي الجرائم التي تستهدف انتهاك حقوق الإنسان على مستوى عال من الجسامة والخطورة، كون غياب جهاز قضائي دولي أدى إلى عدم وجود رادع لدى المجرمين مما دفعهم لارتكاب الكثير من تلك الجرائم وبشكل متكرر وعلى نطاق كبير دون خوف من حساب أو عقاب، ونتيجة لتلك الجهود أنشئت المحكمة الجنائية الدولية التي تمثل نظام العدالة الجنائية على المستوى الدولي.
بحيث تعتبر المحكمة الجنائية الدولية أول محكمة جنائية دولية دائمة أسست عام 1998 بناءً على معاهدة، لمحاسبة مرتكبي أكثر الجرائم خطورة على المستوى العالمي مثل جرائم الحرب والجرائم ضد الإنسانية، وجرائم الإبادة الجماعية، وهنا سنتعرض في هذا الموجز السياساتي للجهود الفلسطينية المبذولة للانضمام للمحكمة لتمكينها من ممارسة اختصاصها وهل هذه الخطوة جاءت في التوقيت المناسب أم خطوة سابقة لأوانها، وسنناقش مدى صلاحية المحكمة الجنائية الدولية النظر في النزاعات الفلسطينية _ الإسرائيلية وذلك للرد على ادعاءات إسرائيل بأن المحكمة لا تملك تلك الصلاحية.
كما سنوضح المخاوف والتحديات وأهم العقبات والضغوطات التي يواجهها صناع القرار في فلسطين خاصة: (رئيس دولة فلسطين، رئيس الوزراء، وزارة الخارجية ووزارة العدل)عند اتخاذ خطوة التوجه للمحكمة الجنائية الدولية والامتثال أمامها كمدعي ضد إسرائيل والضغوطات التي تواجهها المحكمة عند النظر في ملف مساءلة إسرائيل كونها ستشكل سابقة قانونية في تاريخ قضاء المحكمة وهنا سنوضح الضغوطات الإسرائيلية والأمريكية وموقف مجلس الأمن للأمم المتحدة، أي توضيح التداخل السياسي القانوني للصراع الفلسطيني الإسرائيلي، بالإضافة إلى وضع بعض الحلول التي يمكن اتباعها لمواجهة تلك المخاوف والعقبات للوصول لآليات تمكن فلسطين من المساءلة.

The international community has exerted tremendous efforts to establish an effective criminal system to be applied at an international level to prosecute the perpetrators of crimes against human rights which are at a high level of gravity and seriousness, as the absence of an international judicial system has led to a lack of deterrence among criminals, which led them to commit many of these crimes repeatedly and at a large scale without fear of punishment. As a result of those efforts, the International Criminal Court, which represents the criminal justice system at the international level, was established.

The ICC is the first permanent international criminal court established in 1998 on the basis of a treaty to hold accountable the perpetrators of the most serious crimes globally, such as war crimes, crimes against humanity, and genocide. Here we will discuss in summary the Palestinian efforts to join the ICC to enable it to exercise its jurisdiction and whether this step was timely or premature, and we will discuss the validity of the ICC to consider Palestinian-Israeli conflicts to respond to Israel’s claims that the Court does not have that authority.

We will also clarify the concerns, challenges and the most important obstacles and pressures faced by decision makers in Palestine, especially: (The President of the State of Palestine, the Prime Minister, the Ministry of Foreign Affairs and the Ministry of Justice) when taking the step of going to the International Criminal Court and complying with it as a prosecutor against Israel and the pressures the Court faces when considering Israel’s accountability file as it will set a legal precedent in the history of the court. Here we will clarify the Israeli and American pressures and the position of the UN Security Council. That is, to clarify the legal political overlap of the Palestinian-Israeli conflict, as well as to develop some solutions that can be pursued to address those concerns and obstacles to reaching mechanisms that enable Palestine to have Israel held accountable for its actions.
