الطلاق في المسيحية: ما بين المساواة واستقلالية الطوائف (2017)

تهتم الورقة البحثية بدراسة الأثر المترتب على تقييد بعض المنتمين للطوائف المسيحية من إنهاء عقد الزواج من خلال الطلاق على الحقوق والحريات الأساسية، انطلاقاً من الحق الدستوري في المساواة وعدم التمييز، في ظل غياب نص واضح في القانون الأساسي الفلسطيني حول الحق في الزواج وتكوين أسرة وإنهاء هذا الزواج. كما توضح الدراسة مدى تأثير تقييد الحق بإنهاء عقد الزواج من خلال الطلاق على استقلالية الفرد ومدى ارتباطه بالحرية الفردية في اتخاذ القرارات التي يرى الفرد أنها مناسبة، وبالمساواة وعدم التمييز بين المواطنين على أساس الدين أو الطائفة، ويتم تبرير ذلك من خلال نصوص القانون الأساسي الفلسطيني والمواثيق الدولية التي انضمت إليها فلسطين. كما وتم إخضاع الحق بإنهاء عقد الزواج من خلال الطلاق لامتحان التوازن ما بين حق الفرد بالمساواة وعدم التمييز وبين حق الطوائف بالاستقلال في إدارة شؤونها الداخلية.

The paper examines the impact of restricting individuals in certain Christian communities from terminating their marital agreements through divorce, on fundamental rights and freedoms, based on the constitutional right to equality and non-discrimination, and in the absence of a clear text in the Palestinian Basic Law that regulates the right to marry and to form a family, and subsequently the right to terminate marital agreements. Moreover, the study shows how the restriction of the right to terminate the marital agreement through divorce affects the independence of individuals and their freedoms to form suitable decisions, and to equality and non-discrimination based on religion or religious community. This is justified by the provisions of the Palestinian Basic Law and the international conventions to which Palestine had joined. In addition, the right to terminate the marital agreement through divorce was subjected to a balancing exercise; where the right of equality and non-discrimination is balanced against the right of Christian communities’ to manage their internal affairs independently.
