قرارات القضاء الدستوري الفلسطيني: الجزء الثاني(2018-2019) (2020)

 تختص المحكمة الدستورية العليا في فلسطين بالعديد من الاختصاصات التي نظمها القانون الأساسي الفلسطيني المعدل للعام 2003، وقانون المحكمة الدستورية العليا للعام 2006 وتعديلاته، ومنها الرقابة على دستورية القوانين والأنظمة وغيرها، وتفسير نصوص القانون الأساسي والقوانين، وغيرها من الاختصاصات وفقا لضوابط محددة. في هذه الورقة نستعرض القرارات الدستورية الصادرة عن المحكمة الدستورية العليا الفلسطينية، منذ مطلع عام 2018 وحتى نهاية العام 2019، وذلك في قسمين: الأول يتضمن ملخصات حول هذه القرارات –على شكل بطاقات تعريفية- وتشمل: رقم القرار، تاريخ القرار، مكان انعقاد المحكمة، طبيعة الدعوى، آلية الاتصال بالدعوى، الجهة الطاعنة، الجهة المطعون ضدها، الموضوع، ملخص منطوق القرار. أما القسم الثاني منه، فيحتوي –على شكل ملاحق- النص الكامل للقرارات.

The Supreme Constitutional Court in Palestine has many jurisdictions regulated by the 2003 Amended Palestinian Basic Law, and the Law establishing the Supreme Constitutional Court of 2006 and its amendments, including the control of the constitutionality of laws, bylaws and others, the interpretation of the provisions of the Basic Law and Laws, and other jurisdictions according to specific controls. In this paper, we review the constitutional decisions of the Palestinian Supreme Constitutional Court, from the beginning of 2018 until the end of 2019, in two sections: the first contains summaries of these decisions, in the form of identification cards, including: decision number, date of decision, venue of the court, nature of the case, the way the case reached the court, the appellant, the defendant, the subject, the summary of the decision. The second part contains, in the form of annexes, the full text of the court’s decisions.
