الحق في الصحة (2018)

تتناول هذه الورقة توجهات الدساتير الوطنية في حماية الحق في الصحة، وإجراء مقاربات مع التوجهات الدولية بخصوص هذا الحق، والذي يصنّف بأنه من ضمن الحقوق الاقتصادية والاجتماعية، ويتطلب إعماله التزاماً إيجابياً من الدولة. وتوصلت الباحثة إلى أن الصياغات الدستورية والدولية تتقارب في حمايتها للحق في الصحة، وإن اختلفت بإيراد القيود لإعماله. وأثبتت الدراسة بأنه لا يمكن توفير الحماية الدستورية للحق في الصحة إلا من خلال الضمانات القضائية وبالتحديد القضاء الدستوري والإداري؛ فالقضاء الدستوري يهتم بمتابعة مدى التزام السلطة التشريعية بالضوابط الدستورية عند سنها لقوانين ذات علاقة بالحق في الصحة أو من خلال تذكير الدولة بطبيعة التزاماتها الدولية، والمتعلقة بإنفاذ هذه الحقوق المحمية بموجب نصوص دستورية. كذلك يساهم القضاء الإداري في حماية الحق بالصحة ضد تعسف السلطة التنفيذية والمؤسسات التابعة لها، في حال تقاعست عن توفير هذا الحق بكافة توابعه وجوانبه للأفراد.

The right to health is classified within economic and social rights; and requires a positive duty from the state to entrench it. This paper examines the different approaches of national constitutions in protecting the right to health; it further reviews different international approaches regarding this right. The research remarked that the legal drafting of most international and constitutional documents that tackles this right are similar, even if they are differentiated by the restrictions they impose. It has been concluded that a constitutional protection of this right cannot be achieved unless there are judicial guarantees, notably a strong constitutional and administrative judicial system; for a constitutional judiciary will supervise if legislations are compatible with constitutional requirements, in addition to reminding the state of its international obligation that requires implementing protected rights based on constitutional provisions. Furthermore, the administrative judiciary will contribute in protecting the right to health from any executive authority’s abuses such as failing to provide this right – with all its benefits – for individuals.
